Even a first offense for misdemeanor DUI is punishable by up to a year in jail, and a suspension of your driving privileges for three to six months. If you have a commercial driver's license, the potential consequences are often more severe. I have years of experience defending the rights and privileges of people arrested for felony and misdemeanor DUI.
Not all traffic stops and subsequent drunk driving arrests are legitimate. The police do not always follow proper procedures. I will issue all necessary subpoenas and review every aspect of your case to ensure that your constitutional rights are protected. Possible grounds for a successful DUI defense include lack of probable cause to stop your vehicle and detain you, improper administration of the breathalyzer and field sobriety tests, biological factors, and others. Whenever possible, I will seek to suppress evidence and witness testimony through the use of pre-trial motions.
Even if the State's case is very strong, I will fight to protect your license and aggressively negotiate to obtain the best outcome possible. This can include rescission of the Statutory Summary Suspension, reduced charges, and/or DUI supervision (not considered a conviction). If you are not eligible for the restoration of your full driving privileges, I will petition the court for a JDP, or Judicial Driving Permit, that allows you to operate your vehicle during a Statutory Summary Suspension.
